1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of CommentPhotos.com (the “Site”), operated by CommentPhotos.com (“we”, “us”, or “our”). By visiting, browsing, or using any feature of the Site, you confirm that you:

• Are at least 13 years of age (or the digital age of consent in your jurisdiction, whichever is higher);
• Have read and agree to these Terms and our Privacy Policy; and
• Are not prohibited from using the Site under applicable law.

If you are using the Site on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. License to Use the Site

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site solely for your personal, non-commercial purposes, subject to these Terms.

You may:

• Browse and view images displayed on the Site;
• Share links to individual image pages on social networks; and
• Download images for personal, non-commercial use where a download option is provided.

You may not:

• Copy, reproduce, or distribute the Site’s content in bulk or for commercial purposes without prior written permission;
• Scrape, crawl, or data-mine the Site using automated tools beyond what is permitted in our robots.txt;
• Reverse-engineer, decompile, or attempt to extract the Site’s source code; or
• Use the Site in any way that could impair performance or availability for other users.

3. User Conduct & Prohibited Activities

When using the Site you agree not to:

• Submit, share, or link to content that is unlawful, harmful, threatening, abusive, harassing, defamatory, pornographic, or otherwise objectionable;
• Infringe any intellectual property, privacy, or other rights of third parties;
• Upload malware, viruses, or any code intended to disrupt, damage, or gain unauthorised access to systems;
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
• Submit spam, promotional content, or unsolicited communications;
• Circumvent or attempt to circumvent any security measure or access control on the Site; or
• Use the Site in violation of any applicable local, national, or international law or regulation.

We reserve the right to remove any content and to suspend or terminate access for users who violate these rules, without notice.

4. Intellectual Property Rights

The Site’s design, layout, code, logos, and original text content are the property of CommentPhotos.com and are protected by applicable copyright, trademark, and other intellectual property laws.

Images displayed on the Site are either:

• Created or licensed by CommentPhotos.com;
• Submitted by users under the licence described in Section 5; or
• Widely circulated on the internet; we make reasonable efforts to identify and credit sources and will promptly remove content upon a valid DMCA request (see Section 6).

Nothing in these Terms transfers ownership of any intellectual property to you.

5. User-Submitted Content

If you submit images or other content to the Site (“User Content”), you:

• Confirm that you own the content or have all necessary rights and permissions to submit and licence it;
• Confirm that the content does not violate any third-party rights, applicable law, or these Terms;
• Grant CommentPhotos.com a worldwide, royalty-free, perpetual, irrevocable, sub-licensable licence to host, display, distribute, and promote the content on the Site and related channels; and
• Acknowledge that all User Content is subject to review and may be declined or removed at our sole discretion.

We do not claim ownership of your User Content. The licence above ends when you request removal of the content, except to the extent copies have already been distributed.

6. DMCA Copyright Notice

We respect intellectual property rights. If you believe content on the Site infringes your copyright, please send a notice containing the following to our designated agent:

• A physical or electronic signature of the copyright owner or authorised agent;
• Identification of the copyrighted work claimed to be infringed;
• The URL or sufficient description to identify the allegedly infringing material;
• Your contact information (name, address, telephone, email);
• A statement that you have a good-faith belief the disputed use is not authorised by the copyright owner, its agent, or law; and
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

We will respond to valid notices promptly and remove or disable access to infringing content in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512). Repeat infringers may have their access terminated.

7. Third-Party Links & Services

The Site may contain links to third-party websites or services (e.g., social networks, advertisers). These links are provided for convenience only. We do not endorse, control, or accept responsibility for any third-party site or its content, products, or services.

The Site uses the following third-party services which have their own terms and privacy policies:

8. Disclaimers & Warranties

9. Limitation of Liability

To the maximum extent permitted by applicable law, CommentPhotos.com and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Site shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) £50 / $50 / €50.

These limitations do not affect any statutory rights you may have as a consumer and do not exclude liability for death, personal injury, or fraud caused by our negligence.

You agree to defend, indemnify, and hold harmless CommentPhotos.com and its operators from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Site;
• Your violation of these Terms;
• Content you submit to the Site; or
• Your violation of any third-party rights.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Site shall be resolved through good-faith negotiation in the first instance. If negotiation fails, disputes shall be submitted to binding arbitration or the competent courts of the jurisdiction of the Site operator, unless mandatory consumer protection laws in your country require otherwise.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
